Welcome to YTM India. These Terms and Conditions ("Terms") govern your access to and use of our social media management, campaign scheduling, WhatsApp/Email outreach, CRM utilities, and marketing AI platform. Please read these Terms carefully before using our services.

1. Acceptance of Terms

By registering an account, subscribing to our services, or using the YTM India website and platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our platform.

2. Account Registration & Security

To access our platform services, you must register for an account. You agree to provide accurate, current, and complete information during registration and keep your account details updated.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately of any unauthorized access or breach of security. For enhanced security, we recommend disabling browser auto-fill for login credentials on shared devices.

3. Services & Acceptable Use Policy

YTM India provides marketing automation, scheduling, outreach, and analytics tools. You agree to use the platform only for lawful purposes and in compliance with these Terms. You are strictly prohibited from:

• Unsolicited Messaging (Spam): Sending unauthorized bulk messages, unsolicited promotional content, or spam via WhatsApp Business API, Email, or SMS gateways in violation of local laws (e.g. TRAI guidelines in India) or partner policies.
• API Abuse & Scraping: Circumventing platform limits, scraping content, or making excessive API calls that strain or degrade our infrastructure or third-party integrated networks.
• Malicious Content: Uploading, scheduling, or distributing harmful, threatening, abusive, defamatory, or otherwise illegal content or software code through our campaign manager.

4. Third-Party Integrations

Our platform integrates with third-party providers (such as Meta/WhatsApp Business API, Google, LinkedIn, and X). You acknowledge that your use of these integrations is subject to the terms and policies of those external platforms. We are not responsible for any modifications, service suspensions, or policy shifts enforced by these third parties that may affect your campaign delivery or channel integrations.

5. Subscriptions, Payments & Billing

Some services require a paid subscription. You agree to pay all applicable fees as described on our pricing page. Subscriptions are billed on a recurring basis (monthly/yearly) unless cancelled. All payments are non-refundable unless explicitly stated otherwise or required by law.

6. Intellectual Property Rights

All software, dashboard designs, graphics, branding, and content on the YTM India platform are the exclusive property of YTM India and its licensors.

You retain all ownership rights to the directories, CRM contacts, and specific message templates you upload or generate. However, you grant us a limited license to host, store, and process this information solely to execute your requested marketing campaigns and CRM operations.

7. Limitation of Liability

To the maximum extent permitted by applicable law, YTM India is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the platform's uptime, message delivery rates, or campaign performance.

We shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use our services, including lost profits, data loss, or carrier blocking.

8. Termination & Suspension

We reserve the right to suspend or terminate your account and block access to our services at our sole discretion, without prior notice, if we believe you have breached these Terms, abused platform resources, or engaged in illegal activities.

9. Governing Law & Jurisdiction

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Raipur, Chhattisgarh, India.
